DateQuest ist eine kostenlose, werbefreie Begleit-App (Progressive Web App) für Paare mit gemeinsamen Date-Ideen, Challenges, einem Erinnerungsbuch, Statistiken, Zielen, einer Bucket-List und einem Jahresrückblick. Ein zentrales Gestaltungsprinzip von DateQuest ist die lokale Speicherung: Ihre Inhalte verbleiben standardmäßig ausschließlich auf Ihrem Endgerät. In dieser Datenschutzerklärung informieren wir Sie darüber, welche personenbezogenen Daten wir bei der Nutzung der App und der zugehörigen Website unter datequest.net verarbeiten, zu welchen Zwecken und auf welcher Rechtsgrundlage dies geschieht und welche Rechte Ihnen zustehen.

2. Allgemeines zur Datenverarbeitung

2.1 Umfang der Verarbeitung

Wir verarbeiten personenbezogene Daten unserer Nutzerinnen und Nutzer grundsätzlich nur, soweit dies zur Bereitstellung einer funktionsfähigen App sowie unserer Inhalte und Leistungen erforderlich ist. DateQuest ist so konzipiert, dass möglichst wenige personenbezogene Daten anfallen. Sämtliche Inhalte – etwa Paar- und Anzeigenamen, Erinnerungen einschließlich Fotos, Bewertungen, Notizen und optionalem Ort, geplante Dates, Challenges und Fortschritt, Ziele, Bucket-List, Gesprächskarten-Favoriten, Erfolge und Erfahrungspunkte sowie Einstellungen – werden standardmäßig ausschließlich lokal auf Ihrem Endgerät gespeichert und verlassen dieses ohne ein von Ihnen freiwillig angelegtes Konto nicht. Eine Verarbeitung personenbezogener Daten durch uns als Verantwortlichen erfolgt regelmäßig nur nach Ihrer Einwilligung oder wenn eine Rechtsvorschrift die Verarbeitung gestattet.

2.2 Rechtsgrundlagen der Verarbeitung

Soweit wir für Verarbeitungsvorgänge personenbezogener Daten eine Einwilligung der betroffenen Person einholen, dient Art. 6 Abs. 1 lit. a DSGVO als Rechtsgrundlage. Bei der Verarbeitung zur Erfüllung eines Vertrags, dessen Vertragspartei die betroffene Person ist, ist Art. 6 Abs. 1 lit. b DSGVO Rechtsgrundlage; dies gilt auch für vorvertragliche Maßnahmen. Soweit eine Verarbeitung zur Erfüllung einer rechtlichen Verpflichtung erforderlich ist, der wir unterliegen, dient Art. 6 Abs. 1 lit. c DSGVO als Rechtsgrundlage. Ist die Verarbeitung zur Wahrung eines berechtigten Interesses unsererseits oder eines Dritten erforderlich und überwiegen die Interessen, Grundrechte und Grundfreiheiten der betroffenen Person das erstgenannte Interesse nicht, so dient Art. 6 Abs. 1 lit. f DSGVO als Rechtsgrundlage.

2.3 Datenlöschung und Speicherdauer

Die personenbezogenen Daten der betroffenen Person werden gelöscht oder gesperrt, sobald der Zweck der Speicherung entfällt. Eine darüber hinausgehende Speicherung kann erfolgen, wenn dies durch gesetzliche Vorgaben vorgesehen ist, denen wir unterliegen. Lokal auf Ihrem Gerät gespeicherte Inhalte verbleiben so lange, bis Sie diese in der App löschen, die App-Daten über Ihren Browser entfernen oder die App deinstallieren. Serverseitig gespeicherte Daten aus einem optionalen Konto oder Paar-Sync werden gelöscht, sobald Sie Ihr Konto löschen oder den Paar-Space auflösen. Server-Logfiles werden nach sieben Tagen automatisch gelöscht.

2.4 Von Ihnen eingegebene Inhalte

Die Inhalte, die Sie in DateQuest eingeben – etwa Fotos, Notizen, Bewertungen und Angaben zu Ihrer Stimmung („Gefühl“) – bestimmen Sie selbst. In Einzelfällen können solche Inhalte Informationen enthalten, die besondere Kategorien personenbezogener Daten im Sinne des Art. 9 DSGVO berühren (etwa Rückschlüsse auf Gesundheit oder das Liebes- und Sexualleben). Solche Inhalte werden ausschließlich auf Ihre Veranlassung verarbeitet und standardmäßig nur lokal auf Ihrem Gerät gespeichert; nutzen Sie ein Konto mit Paar-Sync, werden sie zusätzlich in Ihrem Paar-Space gespeichert. Rechtsgrundlage für eine etwaige Verarbeitung solcher Daten durch uns ist Ihre ausdrückliche Einwilligung gemäß Art. 9 Abs. 2 lit. a DSGVO in Verbindung mit Art. 6 Abs. 1 lit. a und lit. b DSGVO. Für die rein persönliche oder familiäre Nutzung kann zudem die Haushaltsausnahme des Art. 2 Abs. 2 lit. c DSGVO greifen. Für Inhalte, die andere Personen (etwa Ihren Partner oder Ihre Partnerin) betreffen, sind Sie selbst verantwortlich und stellen sicher, dass Sie zu deren Verarbeitung berechtigt sind (vgl. § 5 der Nutzungsbedingungen).

3. Hosting und Server-Logfiles

Die App und die zugehörige Website werden in einem Rechenzentrum in Deutschland betrieben. Das Hosting der App und der Datenbank erbringt für uns ein sorgfältig ausgewählter Dienstleister, der als Auftragsverarbeiter im Sinne des Art. 28 DSGVO ausschließlich nach unseren Weisungen tätig wird. Bei jedem Aufruf werden durch den Browser Ihres Endgeräts automatisch Informationen an den Server der App übermittelt und vorübergehend in sogenannten Logfiles gespeichert. Erfasst werden dabei die folgenden Daten:

• IP-Adresse des anfragenden Endgeräts
• Datum und Uhrzeit des Zugriffs
• Name und URL der abgerufenen Datei bzw. angefragten Ressource
• übertragene Datenmenge und Meldung über den erfolgreichen Abruf
• verwendeter Browsertyp und Betriebssystem
• die Website, von der aus der Zugriff erfolgt (Referrer-URL), sofern übermittelt

Die vorübergehende Speicherung der IP-Adresse durch das System ist notwendig, um eine Auslieferung der App an Ihr Endgerät zu ermöglichen. Die Verarbeitung dient darüber hinaus der Gewährleistung der Systemsicherheit und -stabilität sowie der technischen Fehlerbehandlung. Rechtsgrundlage ist unser berechtigtes Interesse an einem technisch einwandfreien und sicheren Betrieb gemäß Art. 6 Abs. 1 lit. f DSGVO. Die Logfiles werden nach sieben Tagen automatisch gelöscht. Eine Zusammenführung dieser Daten mit anderen Datenquellen zur Identifizierung einzelner Nutzer erfolgt nicht. Zur Abwehr automatisierter Massenanfragen und missbräuchlicher Nutzung – etwa bei Registrierung, Anmeldung und Passwort-Zurücksetzen – setzen wir zudem eine auf der IP-Adresse basierende Begrenzung der Anfragehäufigkeit (Rate-Limiting) ein und speichern hierfür kurzlebige Zähler. Rechtsgrundlage ist unser berechtigtes Interesse an der Sicherheit und Verfügbarkeit des Dienstes gemäß Art. 6 Abs. 1 lit. f DSGVO.

4. Lokaler Gerätespeicher und Reichweitenmessung

4.1 Technisch notwendiger lokaler Speicher

DateQuest nutzt den lokalen Speicher Ihres Browsers (unter anderem Local Storage und IndexedDB) sowie einen Service Worker, um die App als Progressive Web App bereitzustellen, Ihre Inhalte lokal auf dem Gerät zu sichern und die App auch offline nutzbar zu machen. Dieser lokale Speicher ist für den Betrieb der App technisch unbedingt erforderlich. Die Speicherung von Informationen im Endgerät des Nutzers oder der Zugriff auf bereits im Endgerät gespeicherte Informationen erfolgt insoweit auf Grundlage von § 25 Abs. 2 Nr. 2 TDDDG, da dies zur Bereitstellung des von Ihnen ausdrücklich gewünschten Dienstes unbedingt erforderlich ist. Die zugehörige Verarbeitung personenbezogener Daten stützt sich auf Art. 6 Abs. 1 lit. f DSGVO. Melden Sie sich an einem optionalen Konto an, setzen wir zusätzlich ein technisch notwendiges Sitzungs-Cookie (Bezeichnung „dqsession“), das ausschließlich dazu dient, Sie während der Sitzung angemeldet zu halten. Es handelt sich um ein reines Anmelde-Cookie ohne Tracking- oder Analysefunktion; auch seine Speicherung stützt sich auf § 25 Abs. 2 Nr. 2 TDDDG.

4.2 Cookielose Reichweitenmessung

Sofern aktiviert, setzen wir eine cookielose, von uns selbst betriebene Reichweitenmessung ohne Einbindung von Drittanbietern ein. Es kommen insbesondere kein Google Analytics und kein Meta-Pixel zum Einsatz, es findet kein geräteübergreifendes Tracking und kein Fingerprinting statt, und Ihre IP-Adresse wird für diese Auswertung nicht gespeichert. Diese Reichweitenmessung ist standardmäßig deaktiviert und wird nur nach Ihrer ausdrücklichen Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO (Schalter in den App-Einstellungen) aktiviert. Erfasst werden dann Ereignisse zur Nutzung der App (etwa Seitenaufrufe und ausgelöste Aktionen) mit einer regelmäßig wechselnden, kurzlebigen Sitzungskennung sowie – sofern von Ihnen angegeben – die grobe, selbst eingetragene Stadt Ihres Paarprofils. Solange ein Konto besteht, werden die Ereignisse serverseitig Ihrem Konto zugeordnet; bei einer Kontolöschung wird diese Zuordnung entfernt (anonymisiert). Die Auswertung dient dazu, die Nutzung der App statistisch zu verstehen und die App zu verbessern.

4.3 Verwaltung und Widerruf

Sie können den lokalen Speicher Ihres Browsers jederzeit über die Einstellungen Ihres Browsers einsehen und löschen. Bitte beachten Sie, dass nach dem Löschen des lokalen Speichers auch Ihre lokal gespeicherten Inhalte entfernt werden, sofern Sie zuvor kein Backup über die Export-Funktion erstellt oder kein Konto mit Paar-Sync eingerichtet haben. Eine erteilte Einwilligung zur Reichweitenmessung können Sie jederzeit mit Wirkung für die Zukunft in den App-Einstellungen widerrufen.

5. Kontaktaufnahme per E-Mail

Wenn Sie uns per E-Mail kontaktieren, verarbeiten wir die von Ihnen mitgeteilten personenbezogenen Daten (insbesondere Ihre E-Mail-Adresse und den Inhalt Ihrer Nachricht), um Ihre Anfrage zu bearbeiten und zu beantworten. Rechtsgrundlage für die Verarbeitung ist unser berechtigtes Interesse an der Beantwortung Ihres Anliegens gemäß Art. 6 Abs. 1 lit. f DSGVO; steht die Anfrage im Zusammenhang mit einem Vertrag oder vorvertraglichen Maßnahmen, ist Art. 6 Abs. 1 lit. b DSGVO Rechtsgrundlage. Die im Zusammenhang mit einer Anfrage anfallenden Daten löschen wir, sobald die jeweilige Anfrage erledigt ist und keine gesetzlichen Aufbewahrungspflichten entgegenstehen.

6. Optionales Konto und Paar-Synchronisation

Die Nutzung von DateQuest ist vollständig ohne Konto möglich; in diesem Fall verbleiben alle Inhalte lokal auf Ihrem Gerät. Optional können Sie freiwillig ein Konto anlegen und mit Ihrem Partner oder Ihrer Partnerin einen gemeinsamen Paar-Space bilden, um Ihre Inhalte zwischen beiden Geräten über unsere Server-API unter datequest.net zu synchronisieren. Nur wenn Sie diese Funktion aktiv nutzen, werden Inhalte auf unseren Server in Deutschland übertragen und dort gespeichert.

6.1 Registrierung und Anmeldung

Für die Anlage eines Kontos verarbeiten wir Ihren Namen, Ihre E-Mail-Adresse und Ihr Passwort (mindestens zehn Zeichen). Die Registrierung erfolgt im Double-Opt-in-Verfahren: Nach der Anmeldung senden wir Ihnen eine Bestätigungs-E-Mail an die angegebene Adresse, über die Sie Ihre Registrierung ausdrücklich bestätigen. Noch nicht bestätigte Registrierungen werden in einer gesonderten Warteschlange vorgehalten und nach Ablauf der Bestätigungsfrist automatisch gelöscht. Ihr Passwort wird ausschließlich als kryptografischer Hash gespeichert; eine Speicherung im Klartext findet zu keinem Zeitpunkt statt. Für den Fall, dass Sie Ihr Passwort vergessen, bieten wir einen Zurücksetzungs-Vorgang per E-Mail an. Rechtsgrundlage für die Verarbeitung der Konto- und Anmeldedaten ist die Erfüllung des mit Ihnen geschlossenen Nutzungsvertrags gemäß Art. 6 Abs. 1 lit. b DSGVO; das Double-Opt-in dient zugleich dem Nachweis Ihrer Einwilligung und unserem berechtigten Interesse an der Verhinderung von Missbrauch gemäß Art. 6 Abs. 1 lit. f DSGVO.

Im Zuge der Registrierung bestätigen Sie außerdem die Geltung dieser Datenschutzerklärung und der Nutzungsbedingungen sowie Ihr Mindestalter von 16 Jahren. Zum Nachweis dieser Zustimmung (Rechenschaftspflicht gemäß Art. 5 Abs. 2 und Art. 7 DSGVO) speichern wir zu Ihrer E-Mail-Adresse die zugestimmte Fassung der Rechtstexte, den Zeitpunkt der Zustimmung sowie Ihre IP-Adresse und die Browserkennung (User-Agent). Rechtsgrundlage hierfür sind Art. 6 Abs. 1 lit. c und lit. f DSGVO. Dieser Nachweis wird mit der Löschung Ihres Kontos entfernt, soweit keine gesetzlichen Aufbewahrungspflichten entgegenstehen.

6.2 Paar-Space und Einladungscode

Die Verknüpfung zweier Konten zu einem gemeinsamen Paar-Space erfolgt über einen achtstelligen Einladungscode aus Buchstaben und Ziffern (ohne leicht verwechselbare Zeichen), den ein Partner erzeugt und dem anderen mitteilt. Der Code ist zeitlich befristet und nach dem Einlösen verbraucht; die Weitergabe erfolgt außerhalb der App durch Sie selbst. Innerhalb des Paar-Space wird der gemeinsame Paar-Zustand als Ganzes zwischen den beiden verknüpften Geräten abgeglichen und hierzu auf unserem Server gespeichert. Dazu gehören insbesondere die Paar- und Anzeigenamen, Erinnerungen (einschließlich Fotos, Bewertung, Notiz, Gefühl, Wetter, Kosten, Tags, Datum sowie optionalem Ortsnamen und Standort), geplante Dates, Challenges und Fortschritt, Ziele, Bucket-List, Erfolge und Erfahrungspunkte sowie von Ihnen selbst angelegte Aktivitäten, Challenges und Gesprächskarten. Rein geräte-lokale Einstellungen – etwa Sprache, Benachrichtigungs- und Analyse-Einstellungen sowie ein eigenes Glücksrad – werden nicht synchronisiert und verbleiben auf dem jeweiligen Gerät. Bitte beachten Sie, dass in einem Paar-Space beide Partner Zugriff auf die gemeinsam geführten Inhalte haben. Rechtsgrundlage ist die Vertragserfüllung gemäß Art. 6 Abs. 1 lit. b DSGVO. Ihre Anmeldung wird technisch über das in Abschnitt 4.1 beschriebene, technisch notwendige Sitzungs-Cookie aufrechterhalten; die Übertragung zum Server erfolgt verschlüsselt (HTTPS).

6.3 Backup, Export und Import

Unabhängig von einem Konto stellt Ihnen DateQuest eine Export- und Import-Funktion zur Verfügung, mit der Sie ein lokales Backup Ihrer Inhalte erstellen und wieder einspielen können. Der Export erfolgt als Datei auf Ihrem Gerät; die Kontrolle über diese Datei liegt vollständig bei Ihnen. Wir empfehlen, ein solches Backup vor dem Löschen der App-Daten oder einem Gerätewechsel zu erstellen.

6.4 Löschung von Konto und Paar-Space

Sie können Ihr Konto jederzeit selbst in den App-Einstellungen (Profil › Konto & Partner) endgültig löschen. Aus Sicherheitsgründen ist hierfür eine erneute Eingabe Ihres Passworts erforderlich. Mit der Löschung werden Ihr Konto, der zugehörige Paar-Space und alle darin gemeinsam gespeicherten Inhalte serverseitig unwiderruflich gelöscht; da diese Inhalte dem Paar gemeinsam gehören, stehen sie danach auch dem verknüpften Partner nicht mehr zur Verfügung. Etwaige zu Statistikzwecken erfassten Nutzungsereignisse werden dabei von Ihrem Konto getrennt (anonymisiert). Möchten Sie den Paar-Space verlassen, ohne Ihr Konto zu löschen, können Sie dies gesondert tun; der Partner behält den Paar-Space in diesem Fall. Lokal auf Ihrem Gerät gespeicherte Inhalte sind von einer serverseitigen Löschung nicht betroffen und lassen sich über die App bzw. die Einstellungen Ihres Browsers entfernen.

7. App-Berechtigungen

DateQuest greift nur auf Gerätefunktionen zu, wenn dies für eine von Ihnen aktiv genutzte Funktion erforderlich ist, und stets erst nach Ihrer Freigabe über den Berechtigungsdialog des Betriebssystems. Nachfolgend erläutern wir, wann und wofür die einzelnen Berechtigungen verwendet werden.

7.1 Standort (GPS)

Ihr Standort wird ausschließlich dann verarbeitet, wenn Sie beim Festhalten einer Erinnerung aktiv auf „aktuellen Standort verwenden“ tippen. In diesem Fall wird einmalig Ihre aktuelle Position über die Geolocation-Funktion Ihres Browsers ermittelt und bei der betreffenden Erinnerung gespeichert, damit diese auf der Karte angezeigt werden kann. Es findet keine dauerhafte Standortüberwachung, keine Ortung im Hintergrund und keine Bewegungsverfolgung statt. Der Zugriff erfolgt nur nach vorheriger Freigabe durch Ihr Betriebssystem. Rechtsgrundlage ist Ihre Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO, die Sie durch das Antippen der Funktion und die Freigabe im Betriebssystem erteilen.

7.2 Kamera

Die Kamera bzw. der Foto-Auswahldialog wird genutzt, wenn Sie einer Erinnerung ein Foto hinzufügen möchten – entweder über die Kamera oder die Galerie Ihres Geräts, jeweils über den Auswahldialog des Betriebssystems. Das Bild wird lokal auf Ihrem Gerät verarbeitet, verkleinert (auf maximal 1280 Pixel Kantenlänge komprimiert) und gespeichert; eine Übertragung an unseren Server erfolgt nur, wenn Sie den Paar-Sync aktiviert haben. Rechtsgrundlage ist Ihre Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO; erfolgt die Verarbeitung im Rahmen des Paar-Sync, tritt Art. 6 Abs. 1 lit. b DSGVO hinzu.

7.3 Push-Mitteilungen

DateQuest kann Ihnen optionale Push-Erinnerungen senden, etwa als Erinnerung an geplante Dates. Diese werden über das Standard-Verfahren Web-Push (VAPID) ausgeliefert und ausschließlich nach Ihrer ausdrücklichen Zustimmung aktiviert. Für den Versand wird ein anonymes Push-Abonnement, das heißt ein Endpoint-Token des Push-Dienstes Ihres Browsers, auf unserem Server gespeichert; personenbezogene Inhalte werden dabei nicht mitgesendet. Die eigentliche Zustellung erfolgt technisch über den Push-Dienst Ihres Browser- bzw. Geräteherstellers (z. B. Google Firebase Cloud Messaging bei Chrome/Android, Apple Push Notification service bei Safari/iOS oder Mozilla bei Firefox); an diesen Dienst wird beim Versand Ihr Push-Endpoint übermittelt. Dieser Dienst kann seinen Sitz in einem Drittland (etwa den USA) haben, sodass dabei Daten in ein Drittland übertragen werden können. Soweit eine solche Übermittlung stattfindet, stützt sie sich auf einen Angemessenheitsbeschluss der EU-Kommission – insbesondere das EU-US Data Privacy Framework, soweit der jeweilige Anbieter zertifiziert ist – oder auf geeignete Garantien im Sinne des Art. 46 DSGVO (etwa Standardvertragsklauseln). Sie können die Push-Mitteilungen jederzeit sowohl in den App-Einstellungen als auch in den Einstellungen Ihres Betriebssystems wieder deaktivieren. Rechtsgrundlage ist Ihre Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO, die Sie jederzeit mit Wirkung für die Zukunft widerrufen können.

7.4 Geräteinformationen

Zur Bereitstellung der App, für die Funktion von Push-Mitteilungen und Service Worker sowie zur Fehlerbehandlung verarbeiten wir technische Angaben Ihres Geräts. Dazu gehören insbesondere der Browsertyp, das Betriebssystem und die App-Version sowie – im Rahmen der Server-Logfiles – die IP-Adresse, Datum und Uhrzeit und die angefragte Ressource. Diese Verarbeitung dient dem technisch einwandfreien Betrieb und der Diagnose von Fehlern. Rechtsgrundlage ist unser berechtigtes Interesse gemäß Art. 6 Abs. 1 lit. f DSGVO.

7.5 Speicherung Ihrer Inhalte

Das Grundprinzip von DateQuest ist die lokale Speicherung Ihrer Inhalte auf dem Endgerät. Eine serverseitige Speicherung erfolgt nur, wenn Sie ein optionales Konto anlegen und den Paar-Sync nutzen. Über die Export- und Import-Funktion können Sie jederzeit ein lokales Backup erstellen. Lokal gespeicherte Daten verbleiben auf Ihrem Gerät, bis Sie sie löschen oder die App-Daten entfernen; serverseitig gespeicherte Daten werden gelöscht, sobald Sie Ihr Konto löschen oder den Paar-Space auflösen.

8. Eingebundene Dienste und Kartendarstellung

8.1 Icons und Systemschriften

Zur Darstellung der Benutzeroberfläche verwenden wir Symbole (Icons) und Schriftarten, die lokal in der App ausgeliefert werden oder auf die Systemschriften Ihres Geräts zurückgreifen. Eine Übermittlung Ihrer IP-Adresse an externe Anbieter zum Zweck des Nachladens von Schriften oder Symbolen findet dabei nicht statt.

8.2 Kartendarstellung

Für die Anzeige von Erinnerungen mit gespeichertem Standort auf einer interaktiven Karte verwenden wir die quelloffene Kartenbibliothek „pigeon-maps“. Die Kartenkacheln (die einzelnen Kartenbilder) werden von den Servern der OpenStreetMap Foundation (OSMF) geladen; die OpenStreetMap Foundation ist für die Auslieferung der Kacheln und die dabei anfallenden Server-Protokolle datenschutzrechtlich eigenständig verantwortlich. Damit beim Öffnen der Karte nicht ohne Ihre Zustimmung Daten an die OSMF übermittelt werden, laden wir die Kacheln erst, nachdem Sie in der Kartenansicht aktiv auf „Karte laden“ getippt haben (sogenannte Zwei-Klick-Lösung). Erst dann wird Ihre IP-Adresse an die OpenStreetMap Foundation übermittelt, damit die Kacheln für den angezeigten Kartenausschnitt ausgeliefert werden können; der anfänglich angezeigte Ausschnitt richtet sich nach Ihren gespeicherten Erinnerungsorten. Rechtsgrundlage ist Ihre Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO. Ihre Auswahl wird lokal auf Ihrem Gerät gespeichert; Sie können sie widerrufen, indem Sie die lokalen App-Daten in Ihrem Browser löschen (siehe Abschnitt 4.3). Die Auslieferung der Kacheln erfolgt technisch unter Umständen über ein Content-Delivery-Network; soweit dabei Daten in ein Drittland übertragen werden, stützt sich dies auf einen Angemessenheitsbeschluss der EU-Kommission oder auf geeignete Garantien im Sinne des Art. 46 DSGVO. 8.3 E-Mail-Versanddienst

Für den Versand von Konto-, Bestätigungs- und Passwort-Zurücksetzungs-E-Mails setzen wir einen technischen E-Mail-Versanddienst ein, der als Auftragsverarbeiter für uns tätig ist. Mit diesem Dienstleister haben wir einen Vertrag zur Auftragsverarbeitung gemäß Art. 28 DSGVO geschlossen, der sicherstellt, dass die Verarbeitung Ihrer Daten ausschließlich nach unseren Weisungen und unter Einhaltung der datenschutzrechtlichen Vorgaben erfolgt. Es werden nur die zum E-Mail-Versand erforderlichen Daten, insbesondere Ihre E-Mail-Adresse, verarbeitet.

9. Ihre Rechte als betroffene Person

Werden personenbezogene Daten von Ihnen verarbeitet, sind Sie betroffene Person im Sinne der DSGVO und Ihnen stehen die folgenden Rechte gegenüber uns als Verantwortlichem zu:

Unbeschadet eines anderweitigen verwaltungsrechtlichen oder gerichtlichen Rechtsbehelfs steht Ihnen das Recht auf Beschwerde bei einer Aufsichtsbehörde zu, wenn Sie der Ansicht sind, dass die Verarbeitung Ihrer personenbezogenen Daten gegen die DSGVO verstößt. The protection of your personal data is important to us. DateQuest is a free, ad-free companion app (Progressive Web App) for couples, offering shared date ideas, challenges, a memory book, statistics, goals, a bucket list and an annual review. A core design principle of DateQuest is local storage: by default, your content remains exclusively on your device. In this Privacy Policy we inform you about which personal data we process when you use the app and the associated website at datequest.net, for what purposes and on what legal basis this takes place, and what rights you have.

2. General Information on Data Processing

2.1 Scope of Processing

In principle, we process our users' personal data only to the extent necessary to provide a functional app and our content and services. DateQuest is designed so that as little personal data as possible is generated. All content — such as couple and display names, memories including photos, ratings, notes and an optional location, planned dates, challenges and progress, goals, bucket list, favorite conversation cards, achievements and experience points, as well as settings — is by default stored exclusively locally on your device and does not leave it unless you voluntarily create an account. Processing of personal data by us as controller regularly takes place only with your consent or where a legal provision permits the processing.

2.2 Legal Bases for Processing

Insofar as we obtain the consent of the data subject for processing operations involving personal data, Art. 6(1)(a) GDPR serves as the legal basis. Where processing is necessary for the performance of a contract to which the data subject is party, Art. 6(1)(b) GDPR is the legal basis; this also applies to pre-contractual measures. Where processing is necessary to comply with a legal obligation to which we are subject, Art. 6(1)(c) GDPR serves as the legal basis. Where processing is necessary to safeguard a legitimate interest of ours or of a third party and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Art. 6(1)(f) GDPR serves as the legal basis.

2.3 Data Erasure and Storage Duration

The personal data of the data subject is erased or blocked as soon as the purpose of storage ceases to apply. Storage beyond this may take place where provided for by legal requirements to which we are subject. Content stored locally on your device remains until you delete it in the app, remove the app data via your browser, or uninstall the app. Data stored on the server as part of an optional account or couple sync is deleted as soon as you delete your account or dissolve the couple space. Server log files are automatically deleted after seven days.

2.4 Content You Enter

The content you enter into DateQuest — such as photos, notes, ratings and details about your mood ("feeling") — is determined by you. In individual cases, such content may contain information that touches on special categories of personal data within the meaning of Art. 9 GDPR (for example, inferences about health or your love and sex life). Such content is processed exclusively at your instigation and, by default, stored only locally on your device; if you use an account with couple sync, it is additionally stored in your couple space. The legal basis for any processing of such data by us is your explicit consent pursuant to Art. 9(2)(a) GDPR in conjunction with Art. 6(1)(a) and (b) GDPR. For purely personal or household use, the household exemption under Art. 2(2)(c) GDPR may also apply. For content concerning other persons (such as your partner), you are responsible yourself and ensure that you are entitled to process it (see §5 of the Terms of Use).

3. Hosting and Server Log Files

The app and the associated website are operated in a data center in Germany. Hosting of the app and the database is provided for us by a carefully selected service provider acting as a processor within the meaning of Art. 28 GDPR, exclusively on our instructions. Each time the app is accessed, your device's browser automatically transmits information to the app's server, which is temporarily stored in what are known as log files. The following data is collected in this process:

• IP address of the requesting device
• date and time of access
• name and URL of the file retrieved or resource requested
• amount of data transferred and notification of successful retrieval
• browser type and operating system used
• the website from which access is made (referrer URL), where transmitted

The temporary storage of the IP address by the system is necessary to enable delivery of the app to your device. Beyond this, the processing serves to ensure the security and stability of the system as well as technical troubleshooting. The legal basis is our legitimate interest in the technically flawless and secure operation of the app pursuant to Art. 6(1)(f) GDPR. The log files are automatically deleted after seven days. This data is not merged with other data sources to identify individual users. To ward off automated bulk requests and misuse — for example during registration, login and password reset — we additionally apply an IP-address-based limit on the request frequency (rate limiting) and store short-lived counters for this purpose. The legal basis is our legitimate interest in the security and availability of the service pursuant to Art. 6(1)(f) GDPR.

4. Local Device Storage and Reach Measurement

4.1 Technically Necessary Local Storage

DateQuest uses your browser's local storage (including Local Storage and IndexedDB) as well as a service worker in order to provide the app as a Progressive Web App, to save your content locally on the device and to make the app usable offline. This local storage is strictly technically necessary for the operation of the app. The storage of information on the user's device or access to information already stored on the device takes place on the basis of Section 25(2)(2) of the German Telecommunications Digital Services Data Protection Act (TDDDG), as this is strictly necessary to provide the service you have expressly requested. The associated processing of personal data is based on Art. 6(1)(f) GDPR. If you log in to an optional account, we additionally set a strictly necessary session cookie (named "dqsession") whose sole purpose is to keep you logged in during your session. It is a pure login/authentication cookie without any tracking or analytics function; its storage is likewise based on Section 25(2)(2) TDDDG.

4.2 Cookieless Reach Measurement

Where activated, we use a cookieless, self-operated reach measurement without the integration of third-party providers. In particular, neither Google Analytics nor the Meta Pixel is used, no cross-device tracking and no fingerprinting takes place, and your IP address is not stored for this analysis. This reach measurement is disabled by default and is activated only after your express consent pursuant to Art. 6(1)(a) GDPR (a toggle in the app settings). Where activated, we then record events relating to your use of the app (such as page views and triggered actions) with a regularly rotating, short-lived session identifier, as well as — where you have provided it — the coarse, self-entered city from your couple profile. As long as an account exists, the events are associated with your account on the server side; upon deletion of your account, this association is removed (anonymized). The evaluation serves to statistically understand the use of the app and to improve it.

4.3 Management and Withdrawal

You can view and delete your browser's local storage at any time via your browser settings. Please note that deleting the local storage will also remove your locally stored content, unless you have previously created a backup via the export function or set up an account with couple sync. You can withdraw any consent given to reach measurement at any time with effect for the future in the app settings.

5. Contacting Us by Email

If you contact us by email, we process the personal data you provide (in particular your email address and the content of your message) in order to handle and respond to your request. The legal basis for processing is our legitimate interest in answering your request pursuant to Art. 6(1)(f) GDPR; where the request is connected with a contract or pre-contractual measures, Art. 6(1)(b) GDPR is the legal basis. We delete the data arising in connection with a request as soon as the respective request has been dealt with and no statutory retention obligations preclude deletion.

6. Optional Account and Couple Synchronization

DateQuest can be used entirely without an account; in that case, all content remains locally on your device. Optionally, you may voluntarily create an account and form a shared couple space with your partner in order to synchronize your content between the two devices via our server API at datequest.net. Only if you actively use this function is content transferred to and stored on our server in Germany.

6.1 Registration and Login

To create an account, we process your name, your email address and your password (at least ten characters). Registration takes place using the double opt-in procedure: after signing up, we send a confirmation email to the address provided, via which you expressly confirm your registration. Registrations that have not yet been confirmed are held in a separate queue and automatically deleted once the confirmation period expires. Your password is stored exclusively as a cryptographic hash; it is never stored in plain text. Should you forget your password, we offer a reset procedure by email. The legal basis for processing the account and login data is the performance of the usage agreement concluded with you pursuant to Art. 6(1)(b) GDPR; the double opt-in also serves as evidence of your consent and our legitimate interest in preventing misuse pursuant to Art. 6(1)(f) GDPR.

In the course of registration, you also confirm that this Privacy Policy and the Terms of Use apply and that you are at least 16 years of age. To evidence this consent (accountability pursuant to Art. 5(2) and Art. 7 GDPR), we store — linked to your email address — the version of the legal texts you accepted, the time of acceptance, as well as your IP address and browser identifier (user agent). The legal basis for this is Art. 6(1)(c) and (f) GDPR. This record is removed when your account is deleted, unless statutory retention obligations require otherwise.

6.2 Couple Space and Invitation Code

The linking of two accounts into a shared couple space takes place via an eight-character invitation code consisting of letters and digits (without easily confusable characters) that one partner generates and shares with the other. The code is time-limited and consumed once redeemed; you share it outside the app yourself. Within the couple space, the shared couple state as a whole is synchronized between the two linked devices and stored on our server for this purpose. This includes in particular the couple and display names, memories (including photos, rating, note, mood, weather, cost, tags, date as well as an optional place name and location), planned dates, challenges and progress, goals, bucket list, achievements and experience points, as well as activities, challenges and conversation cards you have created yourself. Purely device-local settings — such as language, notification and analytics settings and a personal fortune wheel — are not synchronized and remain on the respective device. Please note that within a couple space both partners have access to the jointly maintained content. The legal basis is the performance of the contract pursuant to Art. 6(1)(b) GDPR. Your login is technically maintained via the strictly necessary session cookie described in section 4.1; transmission to the server is encrypted (HTTPS).

6.3 Backup, Export and Import

Independently of an account, DateQuest provides you with an export and import function that allows you to create a local backup of your content and restore it. The export is created as a file on your device; you retain full control over this file. We recommend creating such a backup before deleting the app data or switching devices.

6.4 Deletion of Account and Couple Space

You can permanently delete your account yourself at any time in the app settings (Profile › Account & Partner). For security reasons, this requires you to enter your password again. Upon deletion, your account, the associated couple space and all content jointly stored within it are irrevocably deleted on the server side; because this content belongs to the couple jointly, it will then no longer be available to the linked partner either. Any usage events recorded for statistical purposes are dissociated from your account in the process (anonymized). If you wish to leave the couple space without deleting your account, you can do so separately; in that case the partner keeps the couple space. Content stored locally on your device is not affected by server-side deletion and can be removed via the app or via your browser settings.

7. App Permissions

DateQuest only accesses device functions where this is necessary for a function you actively use, and always only after your authorization via the operating system's permission dialog. Below we explain when and for what purpose the individual permissions are used.

7.1 Location (GPS)

Your location is processed exclusively when you actively tap "use current location" while recording a memory. In this case, your current position is determined once via your browser's geolocation function and stored with the respective memory so that it can be shown on the map. There is no permanent location monitoring, no background tracking and no movement tracking. Access takes place only after prior authorization by your operating system. The legal basis is your consent pursuant to Art. 6(1)(a) GDPR, which you grant by tapping the function and authorizing it in the operating system.

7.2 Camera

The camera or photo selection dialog is used when you wish to add a photo to a memory — either via your device's camera or gallery, in each case through the operating system's selection dialog. The image is processed, downscaled (compressed to a maximum edge length of 1280 pixels) and stored locally on your device; transmission to our server takes place only if you have activated couple sync. The legal basis is your consent pursuant to Art. 6(1)(a) GDPR; where processing takes place within the scope of couple sync, Art. 6(1)(b) GDPR additionally applies.

7.3 Push Notifications

DateQuest can send you optional push reminders, for example as a reminder of planned dates. These are delivered using the standard Web Push (VAPID) procedure and are activated exclusively after your express consent. For delivery, an anonymous push subscription — that is, an endpoint token of your browser's push service — is stored on our server; no personal content is sent along with it. The actual delivery is carried out technically via the push service of your browser or device manufacturer (for example Google Firebase Cloud Messaging on Chrome/Android, the Apple Push Notification service on Safari/iOS, or Mozilla on Firefox); when a message is sent, your push endpoint is transmitted to this service. This service may be located in a third country (such as the USA), so that data may be transferred to a third country in the process. Insofar as such a transfer takes place, it is based on an adequacy decision of the EU Commission — in particular the EU-US Data Privacy Framework, where the respective provider is certified — or on appropriate safeguards within the meaning of Art. 46 GDPR (such as standard contractual clauses). You can deactivate push notifications at any time, both in the app settings and in your operating system settings. The legal basis is your consent pursuant to Art. 6(1)(a) GDPR, which you can withdraw at any time with effect for the future.

7.4 Device Information

To provide the app, for the functioning of push notifications and the service worker, and for troubleshooting, we process technical information about your device. This includes in particular the browser type, the operating system and the app version, as well as — within the scope of the server log files — the IP address, date and time and the requested resource. This processing serves the technically flawless operation and the diagnosis of errors. The legal basis is our legitimate interest pursuant to Art. 6(1)(f) GDPR.

7.5 Storage of Your Content

The core principle of DateQuest is the local storage of your content on the device. Server-side storage takes place only if you create an optional account and use couple sync. Via the export and import function you can create a local backup at any time. Locally stored data remains on your device until you delete it or remove the app data; data stored on the server is deleted as soon as you delete your account or dissolve the couple space.

8. Integrated Services and Map Display

8.1 Icons and System Fonts

To display the user interface, we use icons and fonts that are delivered locally within the app or draw on your device's system fonts. Your IP address is not transmitted to external providers for the purpose of loading fonts or icons in this process.

8.2 Map Display

For displaying memories with a saved location on an interactive map, we use the open-source map library "pigeon-maps". The map tiles (the individual map images) are loaded from the servers of the OpenStreetMap Foundation (OSMF); the OpenStreetMap Foundation is itself an independent controller for the delivery of the tiles and the server logs generated in the process. So that no data is transmitted to the OSMF without your consent when the map is opened, we load the tiles only after you have actively tapped "Load map" in the map view (a so-called two-click solution). Only then is your IP address transmitted to the OpenStreetMap Foundation so that the tiles for the displayed map section can be delivered; the section shown initially is based on your saved memory locations. The legal basis is your consent pursuant to Art. 6(1)(a) GDPR. Your choice is stored locally on your device; you can withdraw it by deleting the app's local data in your browser (see section 4.3). Tile delivery may technically take place via a content delivery network; insofar as data is transferred to a third country in the process, this is based on an adequacy decision of the EU Commission or on appropriate safeguards within the meaning of Art. 46 GDPR. The map service does not set a cookie. Information on data protection at the OpenStreetMap Foundation is available at osmfoundation.org/wiki/Privacy_Policy.

8.3 Email Delivery Service

For sending account, confirmation and password-reset emails, we use a technical email delivery service that acts as a processor on our behalf. We have concluded a data processing agreement with this service provider pursuant to Art. 28 GDPR, which ensures that your data is processed exclusively in accordance with our instructions and in compliance with data protection requirements. Only the data necessary for email delivery, in particular your email address, is processed.

9. Your Rights as a Data Subject

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis us as controller:

• right of access to the data stored about you (Art. 15 GDPR)
• right to rectification of incorrect or incomplete data (Art. 16 GDPR)
• right to erasure (Art. 17 GDPR)
• right to restriction of processing (Art. 18 GDPR)
• right to data portability (Art. 20 GDPR)
• right to object to processing (Art. 21 GDPR)
• right to withdraw a given consent with effect for the future (Art. 7(3) GDPR)

To exercise these rights, an informal message to info@geotrace.de is sufficient. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent up to the point of withdrawal.

9.1 Right to Lodge a Complaint with a Supervisory Authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority if you consider that the processing of your personal data infringes the GDPR. The supervisory authority responsible for us is the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA), Promenade 18, 91522 Ansbach, Germany.

10. Changes to This Privacy Policy

We reserve the right to adapt this Privacy Policy so that it always complies with current legal requirements or in order to reflect changes to our services in the Privacy Policy, for example when introducing new functions. The new Privacy Policy will then apply to your renewed visit or continued use. The respective current version is available in the app and at datequest.net.
